Smoking

Smoking inside individual flats is a matter for the lessee to determine. Where a flat is sub-let, the lessee may include a no-smoking clause in the tenancy agreement. Residents who smoke inside their flats should aim to ameliorate the likelihood of smoke seeping into the communal parts of Ormsby.

Statutory regulations established by the Government under the Health Act 2006 prohibit smoking at any time anywhere in the internal communal parts of the building and the freeholder has a duty to report any breaches of these regulations to the Local Authority which has powers to levy fines.

In order to provide a balance between the expectations of smokers and non-smokers, the freeholder has established regulations under the terms of the lease relating to smoking in the external communal parts of the estate. No smoking is permitted at any time in the gardens, paths and doorways at the front of building. Smoking is permitted in the rear gardens beyond the inner service road that links the four back doors of the block. This is to provide an adequate margin between where smoking may occur and open windows of any flats in the block. Smoking debris should be cleared immediately after use - smokers' receptacles are provided adjacent to each main door. Residents are also responsible for ensuring that anyone they invite to Ormsby complies with these requirements. Any breach is likely to result in the issue of an enforcement notice for which an administrative charge of £60 will be levied.
